SAN DIEGO – A San Marcos man has filed a class action against a home improvement marketing company over allegations it placed unsolicited calls to consumers.
Ron Ramos filed a complaint individually and on behalf of all others similarly situated on Sept. 22 in the U.S. District Court for the Southern District of California against DHI Inc., doing business as Classic Home Improvements, and Does 1-10 citing the Telephone Consumer Protection Act.
According to the complaint, the plaintiff alleges that on May 27, he was contacted by the defendant on his cellular telephone using an automatic telephone dialing system or an artificial or prerecorded voice, in an attempt to solicit a purchase of their services. He alleges he gave the defendants no express consent to contact him and that his number is registered in the National Do-Not-Call Registry.
The plaintiffs hold SDHI Inc. and Does 1-10 responsible because the defendants allegedly failed to implement procedures to effectively prevent telephone solicitations and failed to uphold plaintiffs' rights to privacy.
The plaintiff requests a trial by jury and seeks judgment against defendants, damages and other relief that the court deems just. He is represented by Todd M. Friedman, Adrian R. Bacon and Meghan E. George of Law Offices of Todd M. Friedman in Woodland Hills.
