Highland resident alleges Comenity Bank called more than 700 times

RIVERSIDE – A Highland resident has filed a suit against an Ohio debt collector alleging unlawful collection practices.

Amber Peralta filed a complaint on Sept. 22 in the U.S. District Court for the Central District of California, Eastern Division against Comenity Bank and Does 1 through 10 alleging violation of the Telephone Consumer Protection Act and the Rosenthal Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that, between 2015 and 2016, the defendant has contacted her more than 764 times in a four-month period. The plaintiff holds Comenity Bank and Does 1 through 10 responsible because the defendants allegedly used an automatic telephone dialing system to contact plaintiff despite her requests that the calls cease.

The plaintiff requests a trial by jury and seeks $500 in statutory damages, $1,500 in treble damages, all legal fees plus interest and any other relief as the court deems just. She is represented by Kian Mottahedeh and John D. Sarai of SM Law Group APC in Encino.
