SAN DIEGO – A retired veteran's wife alleges she was injured while shopping at the Commissary in Miramar.
Maria Hall filed a complaint on Sept. 23 in the U.S. District Court for the Southern District of California against Ray Mabus, secretary, and Department of the Navy alleging negligence.
According to the complaint, the plaintiff alleges that on Sept. 22, 2014, she was shopping in the Commissary at the U.S. Marine Corps Air Station Miramar for groceries. The suit states she was struck by a glass jar of coconut oil on her right eye that fell as she was trying to procure it from a stack of jars on the uppermost shelf, which resulted in an injury of extra cranial soft-tissue hematoma to the right eye area, cervical spasm and headache. She also alleges she suffered from symptoms of post-concussion syndrome for an extended period of time including nausea, dizziness, difficulty focusing her right eye, memory loss and loss of stamina.
The plaintiff holds Mabus and Department of the Navy responsible because the Commissary personnel allegedly placed goods at an unsafe height and in a precarious configuration.
The plaintiff requests a trial by jury and seeks judgment against defendant, compensatory damages, attorney's fees, costs and further relief as the court deems just. She is represented by Andria Catalano Redcrow of Law Office of Andria Catalano Redcrow in Chula Vista.
