Uber accused of sending unsolicited texts to promote business

SAN FRANCISCO – A Sacramento County man alleges Uber sent him unsolicited text messages.

Henry Fronda filed a complaint individually and on behalf of all others similarly situated on Sept. 28 in the U.S. District Court for the Northern District of California against Uber Technologies Inc. alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that beginning June 29, 2015, he received text messages using an autodialer from the defendant to promote its business. He alleges that the defendant was not provided with express consent or cellular telephone numbers of the class members, thereby causing class members to incur cellular telephone charges and invasion of privacy. 

The plaintiffs hold Uber Technologies Inc. responsible because the defendant allegedly dispatched unsolicited and unauthorized text messages, utilized an auto-dialer and artificial/prerecorded voice and failed to obtain express consent before communicating with class members.

The plaintiff requests a trial by jury and seeks judgment against defendant, certify this as a class action, appoint his representative/counsel, damages, injunctive relief, interest, attorneys' fees, court costs and further relief as the court deems just.
