LOS ANGELES – An Arizona business alleges a Torrance corporation falsely advertises a dietary supplement as safe.
Nutrition Distribution LLC, doing business as Athletic Xtreme, filed a complaint on Sept. 27 in the U.S. District Court for the Central District of California against Boss Sports Nutrition and Does 1 through 10 alleging false advertising.
According to the complaint, both parties manufacture supplements. The plaintiff alleges the defendant markets selective products containing androgen receptor modulators (SARMs) products as safe and does not disclose the purported risk and side effects of SARMs for human consumption.
The plaintiff holds Boss Sports Nutrition and Does 1 through 10 responsible because the defendants allegedly misled customers into purchasing their products without disclosing the potential harmful effects of SARMs that are present in their dietary supplements.
The plaintiff requests a trial by jury and seeks enjoin the defendant, compensatory damages, award all profits, restitution, punitive damages, all legal fees and any other relief as the court deems just. It is represented by Robert Tauler and Matthew J. Smith of Tauler Smith LLP in Los Angeles.
