Man accuses Hartford Life and Accident Insurance Co. of wrongfully denying benefits

LOS ANGELES – A man alleges his benefits were wrongfully denied and has filed suit to determine he is eligible for coverage.

Nalin Atapattu filed a complaint on Sept. 28 in the U.S. District Court for the Central District of California against Hartford Life and Accident Insurance Co. and Wellpoint Health Networks Inc. Group Disability Income Insurance Plan citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in February 2005 he became disabled and was initially approved for disability benefits until benefits were terminated in 2013. The plaintiff holds Hartford Life and Accident Insurance Co. and Wellpoint Health Networks Inc. Group Disability Income Insurance Plan responsible because the defendants allegedly claimed that plaintiff no longer meet the requirements for disability benefits despite plaintiff having sufficient medical records to support his claim.

The plaintiff seeks benefits due to plaintiff plus interest, all legal fees and any other relief as the court deems just. He is represented by Frank N. Darras, Lissa A. Martinez, Susan B. Grabarsky and Phillip S. Bather of DarrasLaw in Ontario.
