Former Wells Fargo employees allege they weren't given rest breaks, paid overtime

SAN FRANCISCO – Former payroll sales representatives for Wells Fargo allege the financial institution violated wage labor laws and have filed a class-action suit.

Jamielynn Cota, Susana Davila and Patty Cha filed a complaint on behalf of all others similarly situated on Sept. 29 in the U.S. District Court for the Northern District of California against Wells Fargo Bank NA alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiffs allege that they worked for more than 40 hours per week without being paid any overtime compensation during their employment with the defendant, were not provided meal and rest breaks and that the defendant did not keep accurate time records.

The plaintiffs request a trial by jury and seek damages, liquidated damages, all wages owed, restitution, all overtime compensation, all legal fees and interest plus any other relief as the court deems just. They are represented by Peter Rukin and Rebecca Stephens of Rukin Hyland Doria & Tindall LLP in San Francisco.
