SAN FRANCISCO – A former employee has filed a class-action suit against the nation's largest leading provider of integrated manage care services over allegations it did not pay field case managers overtime wages.
Leslie Taylor-Thomas filed a complaint on behalf of all others similarly situated on Sept. 30 in the U.S. District Court for the Northern District of California against Genex Holdings Inc., doing business as Genex Services Inc., and Does 1-50 alleging violation of the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that she was employed as a field case manager for the defendants from January 2014 to May and worked for more than 40 hours per week without being paid any overtime compensation. She alleges she was misclassified as a salaried employee and after arbitration determined she should be paid overtime as a non-exempt employee, the defendant did not do so. She alleges she terminated when she told the defendant she would no longer work overtime hours without compensation.
The plaintiff seeks all compensation due to plaintiff, compensatory damages, liquidated damages, restitution, all legal fees and interest plus any other relief as the court deems just.
