CEMI CERI, others accused of copying fabric design

LOS ANGELES – A Los Angeles corporation is accused of copying a fabric design and distributing garments made of the infringing pattern.

Universal Dyeing & Printing Inc. filed a complaint on Oct. 4 in the U.S. District Court for the Central District of California against CEMI CERI Corp., Monroe & Main Inc., Fresh of LA Inc., Solo LA FE, Colormc, Wholesale Fashion Square, Hot Cutie Inc. and Does 1 through 10 alleging copyright infringement.

According to the complaint, the plaintiff alleges it sold more than 4,500 yards of fabric with the UA 13710 design to CEMI CERI in 2011. It alleges CEMI CERI copied the design and the remaining defendants sold or distributed garments with the infringing design.

The plaintiff holds CEMI CERI Corp., Monroe & Main Inc., Fresh of LA Inc., Solo LA FE, Colormc, Wholesale Fashion Square, Hot Cutie Inc. and Does 1 through 10 responsible because the defendants allegedly sold the infringing garments through their retail stores.

The plaintiff requests a trial by jury and seeks enjoin the defendants from further infringing plaintiff's designs, award all profits to plaintiff, all legal fees and interest, and any other relief as this court deems just. It is represented by Stephen M. Doniger, Scott A. Burroughs and Frank Gregory Casella of Doniger/Burroughs in Venice.
