Novatel Wireless Inc. alleges Reliance Communications LLC owes more than $500,000

SAN DIEGO – A San Diego corporation alleges it is owed more than $500,000 for wireless accessories and modems.

Novatel Wireless Inc. filed a complaint on Oct. 12 in the U.S. District Court for the Southern District of California against Reliance Communications LLC alleging breach of contract.

According to the complaint, the plaintiff alleges that on Oct. 13, 2010, it entered into a master purchase agreement under which it agreed to sell and defendant agreed to buy certain mobile broadband wireless data modems and accessories by submitting to plaintiff a non-cancellable, non-changeable purchase order.

The suit states that in October 2015, as a favor to defendant, plaintiff accepted the return of 22,549 MIFI 6620 units worth $3,089,438.49 that it credited back to defendant against amounts due. The plaintiff alleges that there remains an outstanding balance of $549,701.51 plus 1 percent interest per month due to plaintiff that the defendant refuses to pay to date.

The plaintiff requests a trial by jury and seeks judgment in its favor, damages of $549,701.51 plus interest and any further damages as the court may deem just. It is represented by James V. Fazio III and Trevor Q. Coddington of San Diego IP Law Group LLP in San Diego.
