Insurance firm sued over alleged violation of ERISA

CALIFORNIA — An employee is suing Anthem Blue Cross Life and Health Insurance Co., an insurance firm, citing alleged breach of contract and a violation of the Employee Retirement Income Security Act (ERISA).

Shawna Hardy filed a complaint on Oct. 10, in the U.S. District Court for the Central District of California against Anthem Blue Cross Life and Health Insurance Company alleging that the insurance firm denied plaintiff's medical coverage.

According to the complaint, the plaintiff alleges that, in March 2014, she became disabled and had to undergo several medical procedures but her claims for medical coverage was denied. The plaintiff holds Anthem Blue Cross Life and Health Insurance Co. responsible because the defendant allegedly upheld their decision to deny plaintiff's claim for medical coverage despite having sufficient medical records to support her claim.

The plaintiff seeks payment of health benefits due to plaintiff, all legal fees and interest plus any other relief this court deems just. She is represented by Glenn R. Kantor and Timothy J. Rozelle of Kantor & Kantor LLP in Northridge.
