Man alleges Vizio falsely advertises energy savings of televisions

LOS ANGELES – An Illinois consumer has filed a class-action lawsuit alleging that a television manufacturer falsely advertised the power saving mode feature of its televisions.

Andrew Schwartz filed a complaint on behalf of all others similarly situated on Oct. 12 in the U.S. District Court for the Central District of California, Western Division against Vizio Inc. citing breach of express warranty and violation of the Illinois Consumer Fraud Act.

According to the complaint, the plaintiff alleges that he suffered damages from being misled into purchasing a falsely advertised product believing it to be energy efficient. The plaintiff holds Vizio Inc. responsible because the defendant allegedly failed to inform consumers that the energy saving features of its televisions are disabled whenever the picture settings are changed from the factory default settings.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, injunctive relief, restitution, disgorgement, all legal fees and any other relief the court grants. He is represented by Betsy C. Manifold, Rachele R. Rickert and Brittany N. Dejong of Wolf Haldenstein Adler Freeman & Herz LLP in San Diego and by representatives of the same firm in New York and Chicago.
