Lyft Inc. accused of sending unwanted text messages

SAN DIEGO – An individual has filed a class-action suit against a San Diego ride service over allegations it sent unwanted text messages.

Jason David Bodie filed a complaint individually and on behalf of all others similarly situated on Oct. 13 in the U.S. District Court for the Southern District of California against Lyft Inc. citing the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that beginning on Oct. 10, he received two text solicitations on his cellular telephone from the defendant that instructed him to download its application. He states he has never established a business relationship with the defendant or gave his consent to receive the messages. Plaintiff believes that the text messages were sent using an automatic telephone dialing system and he alleges he has suffered from distress and frustration and invasion of his privacy.

The plaintiffs hold Lyft Inc. responsible because the defendant allegedly utilized an auto-dialer and solicited business from class members without express consent.

The plaintiff requests a trial by jury and seeks judgment in his favor, damages, injunctive relief prohibiting such conduct in the future and other relief the court may deem just.
