Woman alleges doctor did not report X-ray findings

Medical malpractice 01

SACRAMENTO – A Fresno woman alleges a doctor did not report a foreign body found in her abdomen that was discovered on an X-ray to her referring doctor.

Debby Genthner filed a complaint on Oct. 12 in the U.S. District Court for the Eastern District of California against Kenneth Chong, Fresno Imaging Center and Does 1-50 alleging that they violated the rights of plaintiff to be properly diagnosed and treated.

According to the complaint, the plaintiff alleges that, on October 7, 2014, she went to see the defendants for an X-ray, when they discovered that a foreign object was embedded inside plaintiff's abdomen area. Despite the defendants' knowledge of her condition, the defendants allegedly failed to report their discovery of her injury to her referring doctor so she could get further treatment. She also alleges that the defendants should have reported the X-ray's findings to the police or authorities for further investigation as she believes she may have been drugged and had the object placed against her will. As a result of defendants' action, plaintiff alleges she continues to suffer from pain and injury.

The plaintiff requests a trial by jury and seeks judgment in her favor, compensatory and punitive damages. She is representing herself.
