Woman sues Credit One Bank, debt collectors for unwanted calls over debt she does not owe

SACRAMENTO — An individual is suing Credit One Financial d/b/a Credit One Bank NA and DOES 1-10, debt collectors, citing alleged violation of the Telephone Consumer Protection Act (TCPA).

Rhonda Hiemstra filed a complaint on Oct. 12, in the U.S. District Court for the Eastern District of California against the defendants alleging that they violated TCPA through intrusive and unwanted calls.

According to the complaint, the plaintiff alleges that she never had any business relationship with the defendants and does not know the alleged debtor they were trying to contact through her cellular telephone. Despite the several times she informed the defendants, they continued calling her almost on a daily basis and multiple times throughout the day, frequently using an auto-dialer or an automated voice, thereby causing plaintiff to suffer from invasion of privacy, annoyance and harassment. The plaintiff holds Credit One Financial d/b/a Credit One Bank NA and DOES 1-10 responsible because the defendants allegedly failed to accommodate plaintiff's demands to cease calling and illegally utilized an auto-dialer and automated voice.

The plaintiff requests a trial by jury and seeks judgment against respondents, damages, costs of litigation, attorney's fees and further relief as may be just. She is represented by Tammy Hussin of Hussin Law in Encinitas.
