Ameritech Financial accuses competitors of false advertising

SAN DIEGO — A student loan assistant company is suing Lisa and Robert P. Farrington Jr., The College Investor LLC and DOES 1-10, individuals, citing alleged false advertising and unfair competition.

Ameritech Financial filed a complaint on Oct. 14, in the U.S. District Court for the Southern District of California against the defendants alleging that they breached its duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that Ameritech Financial is a student loan assistant company (SLAC), which has helped thousands of student loan borrowers attain financial freedom, and was substantially damaged by articles posted and written on defendants' website, discrediting their kind of business and urging borrowers to avoid using SLACs. As a result, plaintiff’s prospective customers are being diverted away from its business and steered toward the competing products and services being promoted on defendants' site. 

The plaintiff holds Lisa and Robert P. Farrington Jr., The College Investor LLC and DOES 1-10 responsible because the defendants allegedly failed to have a conspicuous disclaimer regarding their business relationship with advertisers being promoted on the site, caused plaintiff to lose a substantial amount of revenue and goodwill, and diverted customers away from plaintiff for its own monetary gain.

The plaintiff requests a trial by jury and seeks judgment against defendants, preliminary and permanent injunction, account and disgorgement of profits from false statements, damages, court costs, attorneys' fees, interest, and further relief as the court deems just. They are represented by Daniel R. Warner of Kelly / Warner PLLC in Scottsdale, Arizona and Matthew S. Steinberg of Cozen O'Connor in Los Angeles.
