MyBusinessLoan.com sues borrower for alleged nonpayment of loan

Late 05

SAN DIEGO — A lender is suing Snatch My Waist LLC and Carol Lenoir-Little, borrower and guarantor, citing alleged breach of contract.

MyBusinessLoan.com LLC filed a complaint on Oct. 14, in the U.S. District Court for the Southern District of California against Snatch My Waist LLC and Carol Lenoir-Little alleging that the borrower and guarantor breached their duties of good faith and fair dealing.

According to the complaint, the plaintiff alleges that on March 22, MyBusinessLoan.com LLC entered into a loan agreement with borrower, Defendant Snatch, and guarantor, Defendant Carol, whereby the borrower was obligated to make 104 weekly payments in the amount of $1,605.27 and guarantor was to assume full and prompt payment in case of borrower's delinquency. The borrower allegedly has ceased making the required payments on the loan, thereby causing plaintiff monetary damages in an amount of $124,099.62 plus interest.

The plaintiff holds Snatch My Waist LLC and Carol Lenoir-Little responsible because the defendants allegedly stopped making payments as agreed upon under contract and failed to perform its obligations or defaults under the loan contract.

The plaintiff seeks judgment against guarantor for damages including general, special, consequential and compensatory damages in an amount of at least $124,099.62, interest, attorneys’ fees and costs and further relief as the court deems just.
