'America's Best Dance Crew' winner files suit against mother over use of Chachi mark

LOS ANGELES – The 2011 winner of a dance show alleges her mother is using her trademarks for dance apparel.

Olivia Irene Gonzales, The Chachi Gonzales Brands LLC filed a complaint on Oct. 17 in the U.S. District Court for the Central District of California against Guadalupe Gonzales and Chachimomma Inc. alleging trademark infringement, false designation of origin and other counts.

According to the complaint, the plaintiff was the winner of the 2011 season of MTV's "America's Best Dance Crew" and is known by the nickname of Chachi. The plaintiffs allege they are the owners of the Chachi and Dothead design trademarks. The suit states that she designed her own dance apparel items, which the defendant, her mother, sewed at the time of the show's airing.

The plaintiffs holds Guadalupe Gonzales and Chachimomma Inc. responsible because the defendants allegedly made advertised their business with the plaintiff's name and likeness and use wrongfully use the Chachi and Dothead designs.

The plaintiffs request a trial by jury and seek enjoin the defendant from further infringing plaintiff's trademarks, award damages and profits to the plaintiff, disgorge all money and property obtained from the unlawful act, pay punitive damages, cancellation of U.S. trademark registrations, all legal fees and interest plus any other relief as this court deems just. They are represented by Victor K. Sapphire of Gerard Fox Law, P.C. in Los Angeles.
