Chrome Hearts claims damages over trademark use

CALIFORNIA — A California business is suing Yonada 26 Corp. and DOES 1-10, a California corporation, citing alleged unfair competition.

Chrome Hearts LLC filed a complaint on Oct. 19, in the U.S. District Court for the Central District of California against the defendants alleging that they distributes products that bear the plaintiff's trademark without permission.

According to the complaint, the plaintiff alleges that Chrome Hearts LLC suffered damages to their business as the result of their trademark being used on other products. The plaintiff holds Yonada 26 Corp. and DOES 1-10 responsible because the defendants allegedly used plaintiff's chrome hearts mark on their product which causes confusion among plaintiff's customers.

The plaintiff requests a trial by jury and seeks to enjoin the defendant from further infringing the plaintiff's trademark, an order to the defendant to recall all infringing products for destruction, award all profits and damages to the plaintiff, as well compensatory damages, treble damages, punitive damages, all legal fees and interest plus any other relief as this court deems just.
