SOUTHERN — An individual has filed a class-action lawsuit against Western Dental Services, Inc., and 1 through 50, California corporation, citing alleged violation of telephone harassment statutes.
Claudia Sicairos filed a complaint on behalf of all others similarly situated on Oct. 18, in the U.S. District Court for the Central District of California against the defendants alleging that they contacted plaintiff on her cellular telephone to advertise their services.
According to the complaint, the plaintiff alleges that, in May 2016, she suffered damage from receiving unsolicited text messages on her cellular telephone. The plaintiff holds Western Dental Services, Inc., and 1 through 50 responsible because the defendants allegedly used an automatic telephone dialing system to contact plaintiff.
The plaintiff requests a trial by jury and seeks $500 in statutory damages for each and every violation, to enjoin the defendant, $1,500 in statutory damages for each and every violation, all legal fees and any other relief this court deems just.
