LOS ANGELES – A Colorado company alleges a Newport Beach has not honored a settlement and has not made payments owed to it.
Atlas Mining Group LLC filed a complaint on Oct. 17 in the U.S. District Court for the Central District of California against Kelly Holdings LLC alleging breach of contract.
According to the complaint, the plaintiff alleges that it made two loans to Bunker Hill Ventures that were guaranteed by the defendant. The suit states that the loans were not paid, the plaintiff filed a suit against the defendant, and that a settlement was reached in which the defendant agreed to make payments beginning in September. The plaintiff holds Kelly Holdings LLC responsible because the defendant allegedly defaulted on the settlement agreement due to the unpaid initial payment.
The plaintiff seeks judgment against the defendant, interest, all legal fees and any other relief as this court deems just. It is represented by Brett D. Payton of Coan, Payton & Payne LLC in Greeley, Colorado.
