Malakan Diamond Co. accused of selling rings that infringe NY company's designs

SACRAMENTO – A New York jewelry designing company alleges a Fresno jewelry wholesaler sold items that infringe its copyrighted designs.

Verragio LTD filed a complaint on Oct. 31 in the U.S. District Court for the Eastern District of California against Malakan Diamond Co. alleging copyright infringement, trademark infringement and unfair competition.

According to the complaint, the plaintiff alleges that it suffered damages to its business, including lost profits. The plaintiff holds Malakan Diamond Co. responsible because the defendant allegedly manufactured and sold infringing copies of plaintiff's designs and incorporated them into its rings without authorization of the plaintiff.

 

The plaintiff requests a trial by jury and seeks enjoin the defendant from further infringing plaintiff's designs, award damages to the plaintiff, award the defendant's profits derived from the unlawful acts to the plaintiff, disgorgement, exemplary and punitive damages, all legal fees and any other relief this court deems just.
