SACRAMENTO – A Hanford couple alleges a car dealership made false representations regarding the history of a vehicle they purchased.
Debra Sauceda and Isidro Sauceda filed a complaint on Oct. 28 in the U.S. District Court for the Eastern District of California against Ford Motor Co., Swanson Fahrney Ford Sales and Does 1-30 alleging fraudulent and negligent misrepresentation and other counts.
According to the complaint, the plaintiffs allege that in March, they suffered damages from being misled into purchasing a vehicle at auction that was previously used as a rental car. The suit states that Swanson omitted in advertising for the vehicle that it was previously a rental car. The plaintiffs holds Ford Motor Co., Swanson Fahrney Ford Sales and Does 1-30 responsible because the defendants allegedly failed to disclose to the plaintiff the vehicle's history of being a rental car and failed to properly inform the plaintiff that the vehicle's transmission was a Dual Powershift 6 Speed transmission, which allegedly is problematic and defective.
The plaintiffs seek general damages, incidental and consequential damages, restitution and rescission, statutory damages, punitive damages, all legal fees and any other relief as the court deems just. They are represented by Hallen D. Rosner and Jeffrey L. Le Pere of Rosner, Barry & Babbitt LLP in San Diego.
