Macy's Inc. accused of continuing to send texts after consumer asked to stop

SACRAMENTO – A Placer County resident claims a department store continued to send texts after consent was revoked.

Kyle Johnson filed a complaint on Oct. 28 in the U.S. District Court for the Eastern District of California against Macy's Inc. and Does 1-10 citing the Telephone Consumer Protection Act.

According to the complaint, the plaintiff initially consented to receive texts from the defendant but later requested to stop receiving the messages. The plaintiff holds Macy's Inc. and Does 1-10 responsible because the defendant allegedly continued to send the texts.

The plaintiff seeks $500 in statutory damages for each and every violation, $1,500 in statutory damages for each and every violation, all legal fees and any other relief as the court deems just. The plaintiff is represented by Scott J. Ferrell and Victoria C. Knowles of Pacific Trial Attorneys APC in Newport Beach.
