LOS ANGELES – A Los Angeles County individual alleges a San Francisco debt collector harassed him with calls.
David Lucero filed a complaint on Oct. 27 in the U.S. District Court for the Central District of California, Western Division against Prosper Funding LLC alleging violation of the Telephone Consumer Protection Act and the Rosenthal Fair Debt Collection Practices Act.
According to the complaint, the plaintiff alleges that beginning in 2016, he suffered damages from receiving numerous collection calls. The plaintiff holds Prosper Funding LLC responsible because the defendant allegedly used an automatic telephone dialing system to contact the plaintiff and continued to contact him after he requested the calls stop.
The plaintiff seeks statutory damages, punitive damages, interest, all legal fees and any other relief as the court deems just. He is represented by Matthew A. Rosenthal of Westgate Law in Los Angeles.
