Southwest Industrial Rigging accused of not paying more than $150,000 in contributions

LOS ANGELES – Labor union groups allege an Arizona corporation owes more than $150,000 in unpaid contributions.

Carpenters Southwest Administrative Corp. and board of trustees for the Carpenters Southwest Trusts filed a complaint on Oct. 28 in the U.S. District Court for the Central District of California against HKB Inc., doing business as Southwest Industrial Rigging; Harry Kent Baker; Scott William Miller; James Douglas Wilson; and Does 1 through 10 citing the Labor-Management Relations Act and the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that recent audits of the defendant's records indicate that they failed to report and pay all contributions. The plaintiffs hold the defendants responsible because the defendants allegedly breached their bargaining agreement with plaintiff by failing to make benefit contributions on behalf of their employees.

The plaintiffs seek funds withheld from employees in the sum of $154,709.85 plus interest for sums withheld from the vacation and annuity plans, $408,646.56 for contributions owing, all legal fees and any other relief as the court deems just. They are represented by Jodi Siegner of DeCarlo & Shanley in Los Angeles.
