LOS ANGELES – A Los Angeles business claims it was sent junk faxes from a Riviera Beach, Florida company and has filed a class-action suit.

Jennifer Botelho, doing business as Chiropractic Center of Los Angeles, filed a complaint on Oct. 31 in the U.S. District Court for the Central District of California against Technological Medical Advancements LLC citing Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that in July, she suffered damages from receiving 14 unsolicited fax advertisements from the defendant concerning its Diowave product. The plaintiff holds Technological Medical Advancements LLC responsible because the defendant allegedly sent fax advertisements without the plaintiff's permission.

The plaintiff requests a trial by jury and seeks $500 for each violation, to enjoin the defendant, interest, all legal fees and any other relief as the court deems just. She is represented by Peter J. Gimino III of The Gimino Law Office APC in Irvine and Steven L. Woodrow and Patrick H. Peluso of Woodrow & Peluso LLC in Denver, Colorado.
