LOS ANGELES – A labor union trust alleges it has been denied an audit of an employer's records.
Carpenters Southwest Administrative Corp. and the board of trustees for the Carpenters Southwest Trust filed a complaint on Oct. 28 in the U.S. District Court for the Central District of California, Western Division against Cesar Hernandez, individually and doing business as C J R Construction citing the Labor Management Relations Act and the Employee Retirement Income Security Act.
According to the complaint, the plaintiffs allege that they requested access to the defendant's records for the purpose of conducting an audit and that the defendant has failed or refused this request.
The plaintiffs seek an audit of employer business records, contributions, all legal fees and any other relief as the court deems just. They are represented by Jodi Siegner of DeCarlo & Shanley in Los Angeles.
