SAN FRANCISCO – A San Mateo County man formerly employed by Apple alleges coverage for treatment he needed was denied by his insurer.
Chris Bell filed a complaint on Nov. 2 in the U.S. District Court for the Northern District of California against UnitedHealthCare, Apple Group Health Insurance Plan and Does 1 through 10 citing the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that from February to April, he received treatment at an inpatient facility for psychiatric and psychological problems as recommended by his doctor and that the defendants denied coverage of the treatment. The plaintiff holds UnitedHealthCare, Apple Group Health Insurance Plan and Does 1 through 10 responsible because the defendants allegedly denied plaintiff's benefits based on their claim that his treatment wasn't medically necessary.
The plaintiff seeks all benefits due to the plaintiff plus interest, all legal fees and any other relief as the court deems just. He is represented by Charles J. Fleishman and Paul A. Fleishman of The Fleishman Law Firm in Woodland Hills.
