J.H. Simpson Co. Inc. accused of not paying employee contributions

SAN FRANCISCO – An employer is accused of not paying for several months of employee contributions to a labor union fund.

Sheet Metal Workers Pension Plan of Northern California, its board of trustees and Trustee Rick Werner filed a complaint on Nov. 2 in the U.S. District Court for the Northern District of California against J.H. Simpson Co. Inc. citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that they suffered damages from late paid and unpaid contributions in 2015 and 2016. The plaintiffs hold J.H. Simpson Co. Inc. responsible because the defendant allegedly breached their bargaining agreement with the plaintiff by failing to pay their employee's contribution.

The plaintiffs seek unpaid contributions, liquidated damages, interest, enjoin the defendant, all legal fees and any other relief as the court deems just. They are represented by Michele R. Stafford and Edward D. Winchester of Saltzman & Johnson Law Corp. in San Francisco.
