LOS ANGELES – A Los Angeles-based beauty product manufacturer alleges another company is using its name on a nail product.
American International Industries filed a complaint on Nov. 1 in the U.S. District Court for the Central District of California, Western Division against Dara Inc. and Does 1 to 10 alleging false designation and unfair competition.
According to the complaint, the plaintiff alleges the defendant is selling Skywei nail foil products using the plaintiff's name and address without its permission. The plaintiff holds Dara Inc. and Does 1 to 10 responsible because it alleges the defendant's product will cause confusion to the public that it is affiliated with the plaintiff.
The plaintiff seeks injunctive relief against the defendants, order the defendant to deliver all products to the plaintiff, damages, disgorgement, punitive and exemplary damages, all legal fees and any other relief as the court deems just.
