LOS ANGELES – A Seal Beach entertainment services company alleges that several individuals are using its mark.
Noise Group LLC filed a complaint on Nov. 7 in the U.S. District Court for the Central District of California against The Growlers LLC; Brooks Nielsen, individually and doing business as the Growlers; Matt Taylor, and doing business the Growlers; Tournado Inc.; Beach Goth Festival LLC alleging trademark infringement.
According to the complaint, the plaintiff alleges that it has common law rights to the marks Beach Goth Party, Beach Goth, Beach Goth Fest and Beach Goth Festival. The plaintiff holds the defendants responsible because the defendants allegedly used plaintiff's Beach Goth mark on similar merchandise, which it alleges causes confusion among its consumers.
The plaintiff requests a trial by jury and seeks damages, disgorgement, enjoin the defendant from further infringing plaintiff's mark, all legal fees and any other relief as the court deems just. It is represented by Shane W. Tseng and Justin C. Bentley of Lamb & Kawakami LLP in Los Angeles.
