LOS ANGELES – Several wholesalers and retailers are accused of reproducing a textile design without permission.
Fabric Selection Inc. filed a complaint on Nov. 16 in the U.S. District Court for the Central District of California against NNW Import Inc., LIFO Inc., Superline Inc., Lady Monkey Apparel Inc., Eve Yun Design Corp., Zulily LLC, Styles for Less Inc. and Does 1 through 10 alleging copyright infringement.
According to the complaint, the plaintiff alleges that it suffered damages to its business. The plaintiff holds NNW Import Inc., LIFO Inc., Superline Inc., Lady Monkey Apparel Inc., Eve Yun Design Corp., Zulily LLC, Styles for Less Inc. and Does 1 through 10 responsible because the defendants allegedly copied plaintiff's SE30382 design and incorporated it into their products, which they sold to consumers.
The plaintiff requests a trial by jury and seeks permanent injunction against the defendants, to recall and destroy all garments with the infringing design, actual damages and profits, statutory damages, all legal fees and any other relief as the court deems just.
