LOS ANGELES – A Los Angeles company alleges its textile designs were illegally distributed.
Star Fabrics Inc. filed a complaint on Nov. 18 in the U.S. District Court for the Central District of California against Bidding Unlimited Inc., doing business as bidz.com and Modnique, and Does 1-10 alleging copyright infringement.
According to the complaint, the plaintiff alleges that it owns several original two-dimensional artworks used for purposes of textile printing that have been registered with the United States Copyright Office. It alleges the defendant copied and distributed these artworks without any consent or license from plaintiff. The plaintiff holds Bidding Unlimited Inc., doing business as bidz.com and Modnique, and Does 1-10 responsible because the defendants allegedly obtained profit at the expense of plaintiff, introduced an infringing product into the stream of commerce and caused plaintiff to suffer monetary damages.
The plaintiff requests a trial by jury and seeks judgment in its favor, enjoin defendants from further infringement, award profits from infringement, attorneys’ fees, interest, costs of action and further relief as the court deems proper. They are represented by Stephen M. Doniger, Scott A. Burroughs and Howard S. Han of Doniger/Burroughs in Venice.
