LOS ANGELES – Several companies are being accused of using the trademarks of several music groups on merchandise without authorization.
Bravado International Group Merchandising Services Inc. and Zion Rootswear LLC filed a complaint on Nov. 21 in the U.S. District Court for the Central District of California Gearlaunch Inc., Michael Schell, Thatcher Claflin Spring, Barrett Summerlin, Sunfrog LLC, Merchpond Manufacturing LLC, Josh Kent, The Dream Junction LLC and Blair Dorsey alleging trademark infringement.
According to the complaint, the plaintiffs allege that they have the exclusive rights to sell merchandise for several music groups, including the Rolling Stones, Lady Gaga and Muse. The plaintiffs holds Gearlaunch Inc., Schell, Thatcher Claflin Spring, Barrett Summerlin, Sunfrog LLC, Merchpond Manufacturing LLC, Kent, The Dream Junction LLC and Dorsey responsible because the defendants allegedly advertised and distributed goods that contain the musical performers' marks.
The plaintiffs seek enjoin the defendants from further infringing the marks, statutory damages of no less than $750 for each name and/or likeness they have used, punitive damages, statutory damages of $2 million, statutory damages of $1.5 million, all legal fees and interest plus any other relief as the court deems just.
