Apollo Apparel Group, others accused of using Unicolors Inc. designs without authorization

LOS ANGELES – A Vernon company alleges that its copyrighted fabric designs were used for garments without its permission.

Unicolors Inc. filed a complaint on Nov. 22 in the U.S. District Court for the Central District of California against Apollo Apparel Group LLC, doing business as 1st Kiss; Burlington Stores Inc.; Ross Stores Inc.; and Does 1 through 10 alleging copyright infringement.

According to the complaint, the plaintiff alleges that it suffered damages to its business. The plaintiff holds Apollo Apparel Group LLC, doing business as 1st Kiss; Burlington Stores Inc.; Ross Stores Inc.; and Does 1 through 10 responsible because the defendants allegedly distributed or sold fabrics that bear plaintiff's designs.

The plaintiff requests a trial by jury and seeks enjoin the defendants from further infringing plaintiff's designs, award all profits to the plaintiff, all legal fees and interest plus any other relief as the court deems just.
