LOS ANGELES – A Santa Barbara corporation alleges its footage was used in a production about the military without its permission.

Pacific Coast Video Inc. filed a complaint on Nov. 23 in the U.S. District Court for the Central District of California against Public Broadcasting Service (PBS), Fleisherfilm Inc., PBS SoCal/KOCE, KVCR-DT and KLCS alleging copyright infringement and unfair competition.

According to the complaint, the plaintiff alleges that it suffered damages to its business as the result of its work being used in the production “Navy SEALs - Their Untold Story." The suit states the work was produced by Fleisherfilm and aired on PBS stations in 2014. The plaintiff holds Public Broadcasting Service (PBS), Fleisherfilm Inc., PBS SoCal/KOCE, KVCR-DT and KLCS responsible because the defendants allegedly continue to broadcast of “Navy SEALs - Their Untold Story” despite plaintiff's notice of copyright infringement.

The plaintiff requests a trial by jury and seeks payment of all profits and damages, statutory damages, all legal fees and any other relief as the court deems just. It is represented by John W. Holcomb and Hans L. Mayer of Knobbe, Martens, Olson & Bear LLP in Irvine and Los Angeles.
