Ear Charms Inc. claims New York company is selling counterfeit earrings

SANTA ANA – A Laguna Beach earring designer alleges a New York company is unlawfully copying its designs.

Ear Charms Inc. filed a complaint on Nov. 21 in the U.S. District Court for the Central District of California, Southern Division against Bling Jewelry Inc., doing business as Blingjewelry.com, Elena Castaneda and Does 1 to 10 alleging copyright infringement.

According to the complaint, the plaintiff alleges that it suffered damages to its business. The plaintiff holds Bling Jewelry Inc., Castaneda and Does 1 to 10 responsible because the defendants allegedly manufactured and distributed counterfeit copies of plaintiff's products.

The plaintiff requests a trial by jury and seeks award of general, special and consequential damages; exemplary and punitive damages; all legal fees and restitution; injunction against the defendants and any other relief as the court deems just. It is represented by David A. Berstein, Nicholas D. Myers and Michael J. Carey of Myers Berstein LLP in Irvine.
