SANTA ANA – A Laguna Beach earring designer alleges a New York company is unlawfully copying its designs.
Ear Charms Inc. filed a complaint on Nov. 21 in the U.S. District Court for the Central District of California, Southern Division against Bling Jewelry Inc., doing business as Blingjewelry.com, Elena Castaneda and Does 1 to 10 alleging copyright infringement.
According to the complaint, the plaintiff alleges that it suffered damages to its business. The plaintiff holds Bling Jewelry Inc., Castaneda and Does 1 to 10 responsible because the defendants allegedly manufactured and distributed counterfeit copies of plaintiff's products.
The plaintiff requests a trial by jury and seeks award of general, special and consequential damages; exemplary and punitive damages; all legal fees and restitution; injunction against the defendants and any other relief as the court deems just.
