DNA Vapor LLC alleges Cosmic Fog Vapors infringed Milk and Honey mark

LOS ANGELES – A Los Angeles e-liquid manufacturer claims a Newport Beach company is offering a similar product under a similar name.

DNA Vapor LLC filed a complaint on Nov. 22 in the U.S. District Court for the Central District of California against Cosmic Fog Vapors LLC alleging trademark infringement.

According to the complaint, the plaintiff alleges that DNA Vapor LLC suffered damages to its business as the result of its Milk and Honey trademark being used without its permission. The plaintiff holds Cosmic Fog Vapors LLC responsible because the defendant allegedly manufactured and distributed a similarly named product to consumers without paying a license fee to the plaintiff.

The plaintiff seeks injunctive relief, disgorgement, award profits and damages to the plaintiff; punitive, enhanced and exemplary damages; other damages; destruction of all infringing materials; all legal fees and any other relief as the court deems just.
