LOS ANGELES – The copyright owner of textile design alleges the design was used in garments for sale without its permission.
Unicolors Inc. filed a complaint on Nov. 28 in the U.S. District Court for the Central District of California against Apollo Apparel Inc., doing business as Harmony + Havoc; Danice Stores of 125th Street Inc.; Ross Stores Inc.; and Does 1-10 alleging copyright infringement.
According to the complaint, the plaintiff alleges that it suffered damages to its business. The plaintiff holds Apollo Apparel Inc., doing business as Harmony + Havoc; Danice Stores of 125th Street Inc.; Ross Stores Inc.; and Does 1-10 responsible because the defendants allegedly used online and retail stores to sell and distribute garments that feature plaintiff's designs.
The plaintiff requests a trial by jury and seeks enjoin the defendants from further infringing plaintiff's copyrights, award all profits and damages to the plaintiff, all legal fees and interest plus any other relief as this court deems just.
