LOS ANGELES – A Santa Monica resident claims a Texas-based debt collector called multiple times a day.
David Doerken filed a complaint on Nov. 29 in the U.S. District Court for the Central District of California against USAA Federal Savings Bank and Does 1-10 citing the Telephone Consumer Protection Act.
According to the complaint, the plaintiff alleges that in 2016, he suffered damages from receiving several collection calls on his cellular telephone from the defendant. The plaintiff holds USAA Federal Savings Bank and Does 1-10 responsible because the defendants allegedly used an automatic telephone dialing system to call the plaintiff and continued to call after he revoked his consent and instructed that he was represented by counsel.
The plaintiff requests a trial by jury and seeks statutory damages, actual damages, all legal fees and any other relief as the court deems just. He is represented by Stuart Price of Price Law Group APC in Encino.
