S.A.N. Nutrition alleges its Blaze mark is unlawfully being used to sell supplements

Trademark 03

LOS ANGELES – An Oxnard nutritional supplement manufacturer alleges another company is selling a similar product under a similar name.

S.A.N. Nutrition Corp. filed a complaint on Nov. 29 in the U.S. District Court for the Central District of California against American Muscle Supply Inc., doing business as Chrome Supps, and Does 1-10 alleging trademark infringement.

According to the complaint, the plaintiff alleges that it is the owner of the trademark Blaze and suffered damages to its business. The plaintiff holds American Muscle Supply Inc. and Does 1-10 responsible because the defendant allegedly used the Blaze mark on a similar product, which the plaintiff alleges could cause confusion to consumers.

The plaintiff requests a trial by jury and seeks enjoin the defendant from further infringing plaintiff's mark, compensatory damages, treble damages, punitive damages, deliver up for destruction all infringing materials, all legal fees and any other relief as the court deems just. It is represented by Marc A. Karish of Karish & Bjorgum PC in Pasadena.
