LOS ANGELES – An owner of a copyrighted textile design alleges the pattern was used without its permission for clothing.
Jitrade Inc. filed a complaint on Nov. 29 in the U.S. District Court for the Central District of California against New Moa Collection Inc., doing business as Moa USA; Zenu Fashion Inc. and Does 1-10 citing copyright infringement.
According to the complaint, the plaintiff alleges that it suffered damages to its business. The plaintiff holds New Moa Collection Inc., Zenu Fashion Inc. and Does 1-10 responsible because the defendants allegedly used online and retail stores to sell garments comprised of fabrics that contain plaintiff's designs.
The plaintiff requests a trial by jury and seeks enjoin the defendants from further infringing plaintiff's designs, award profits and damages to the plaintiff, statutory damages, all legal fees and interest plus any other relief as the court deems just.
