A man alleges Prudential and Rite Aid Corp. terminated disability payments without cause

CALIFORNIA — A man is suing the Prudential Insurance Company of America; Rite Aid Corp. Long Term Disability Plan and Does 1 to 10, insurance firm, citing alleged breach of contract.

Antonio M. Flores filed a complaint on Nov. 30, in the U.S. District Court for the Central District of California against the defendants alleging that they denied plaintiff's claim for disability benefits.

According to the complaint, the plaintiff alleges that, in 2013, he became disabled and was initially being paid disability benefits until those benefits were suddenly terminated. The plaintiff holds the Prudential Insurance Company of America; Rite Aid Corp. Long Term Disability Plan and Does 1 to 10 responsible because the defendants allegedly upheld their decision to deny plaintiff's claim for disability benefits despite still being disabled according to the terms of the plan.

The plaintiff seeks payment of disability benefits at the rate of $3,164 per month plus interest, all legal fees and any other relief as this court deems just. He is represented by Kevin M. Zietz of Law Offices of Kevin Zietz in Encino.
