Woman alleges Lincoln National Life Insurance wrongfully denied disability benefits

CALIFORNIA — An employee is suing The Lincoln National Life Insurance Co. and Moffatt & Nichol Long Term Disability Plan, insurance firm, citing alleged breach of contract.

Depika Vidyarthi filed a complaint on Dec. 1, in the U.S. District Court for the Central District of California against the defendants alleging that they denied plaintiff's claim for disability benefits.

According to the complaint, the plaintiff alleges that, in 2015, she became disabled and applied for long term disability benefits but was denied. The plaintiff holds The Lincoln National Life Insurance Co. and Moffatt & Nichol Long Term Disability Plan responsible because the defendants allegedly upheld their decision to deny plaintiff's disability benefits despite being disabled according to the terms of the plan.

The plaintiff seeks payment of plaintiff's disability benefits, an order for the defendant to pay the plaintiff disability benefits for as long as she remains disabled plus interest, all legal fees and any other relief as this court deems just.
