Fraiche Textile Inc. claims fabric design was reproduced without authorization

LOS ANGELES – The owner of a copyrighted textile design based in Los Angeles County alleges the design was unlawfully reproduced for garments.

Fraiche Textile Inc. filed a complaint on Dec. 1 in the U.S. District Court for the Central District of California against Umgee U.S.A. Inc., Reality Check, Small Town Boutique, Bestnbestfashion.com, et al. alleging copyright infringement.

According to the complaint, the plaintiff alleges that it suffered damages to its business. The plaintiff holds Umgee U.S.A. Inc., Reality Check, Small Town Boutique, Bestnbestfashion.com, et al. responsible because the defendants allegedly distributes and sells garments containing an infringing design belonging to plaintiff through their retail stores and online.

The plaintiff requests a trial by jury and seeks enjoin the defendant, award all profits to the plaintiff, statutory damages, all legal fees and interest plus any other relief as the court deems just. It is represented by Stephen M. Doniger, Scott Alan Burroughs, Trevor W. Barrett and Justin M. Gomes of Doniger/Burroughs in Venice.
