SAN FRANCISCO – A Napa winery alleges other wineries are marketing products using its trademark.
JC Waugh Wine Co. LLC filed a complaint on Dec. 2 in the U.S. District Court for the Northern District of California against Bronco Wine Co., Panther Rock Wines LLC, Classic Wines of California, Barrel Ten Quarter Circle Inc. and Does 1-14 alleging trademark infringement.
According to the complaint, the plaintiff alleges that it is the owner of the trademark Six Degrees for wine, and that since Sept. 13, 2006, plaintiff's founder has registered the internet URL, sixdegreeswine.com and 6degreeswine.com. From about Jan. 10, 2013, to date, it alleges the defendants have been selling and distributing a Six Degrees brand wine with infringing marks to various consumers and retailers.
The plaintiff holds Bronco Wine Co., Panther Rock Wines LLC, Classic Wines of California, Barrel Ten Quarter Circle Inc. and Does 1-14 responsible because the defendants allegedly caused confusion among consumers by offering similar products and using the same marks as plaintiff's distinctive marks.
The plaintiff requests a trial by jury and seeks judgment against defendants, enjoin defendants from further infringement, recall all infringing products, disgorge all wrongful profits, damages, attorneys' fees, and further relief as the court deem just.
