LOS ANGELES – A Los Angeles manufacturer of nutritional supplements alleges a Delaware company is selling a migraine relief supplement in violation of the plaintiff's patent.
Akeso Health Sciences LLC filed a complaint on Dec. 5 in the U.S. District Court for the Central District of California, Western Division against Threshold Enterprises LTD. alleging patent infringement.
According to the complaint, the plaintiff alleges that it suffered damages to its company. The plaintiff holds Threshold Enterprises TD responsible because the defendant allegedly manufactured and distributed plaintiff's MigreLief, which it claims infringes at least one claim of plaintiff's '999 and '450 patents.
The plaintiff requests a trial by jury and seeks pay actual damages to the plaintiff, increased damages of three times the compensatory damages, all legal fees and any other relief the court deems just. It is represented by Shawn G. Hansen of Nixon Peabody LLP in Los Angeles.
