LOS ANGELES – Two Colorado individuals are accused of selling counterfeit automotive parts on eBay.
Robert Bosch GmbH and Robert Bosch LLC filed a complaint on Dec. 5 in the U.S. District Court for the Central District of California against Chase Murdoch, Jack Stewart and Mile High Auto Parts alleging trademark infringement and trademark counterfeiting.
According to the complaint, the plaintiffs allege that they suffered damages to their business and reputation. The plaintiffs hold Murdoch, Stewart and Mile High Auto Parts responsible because the defendants allegedly used eBay to distribute automotive parts that bear plaintiffs' mark when the products are not genuine Bosch products.
The plaintiffs request a trial by jury and seek enjoin the defendants from further infringing plaintiffs' mark, pay the plaintiffs all profits derived from the allegedly unlawful acts, treble damages, actual damages, statutory damages of $2 million per each counterfeit trademark, order the defendants to deliver up for destruction all infringing materials, all legal fees and any other relief as the court deems just.
