LOS ANGELES – A class-action suit has been filed against BMW over allegations the range extender on a certain electric car causes the vehicle to lose power.
Hakop Demirchyan filed a complaint on behalf of all others similarly situated on Dec. 6 in the U.S. District Court for the Central District of California against BMW of North America LLC, BMW AG and Does 1 through 100 citing breach of express warranty and citing the California Unfair Competition Act and other counts.
According to the complaint, the plaintiff alleges that she suffered damages from purchasing an electric BMW i3 REX vehicle that did not perform as well as advertised. The plaintiff holds BMW of North America LLC, BMW AG and Does 1 through 100 responsible because the defendants allegedly did not disclose to consumers that all of the BMW i3 REX vehicles manufactured for the U.S. lose power when the range extender is operating.
The plaintiff requests a trial by jury and seeks actual damages, statutory damages of not less than $1,000 per plaintiff or class member, restitution, compensatory damages, treble damages, interest, enjoin the defendant, all legal fees and any other relief as the court deems just.
